These Terms of Service ("Terms") govern your access to and use of Crestwave, including our websites, dashboard, mobile experience, market intelligence tools, subscription services, and related support. By using Crestwave, you agree to these Terms.

1. Eligibility and accounts

You must be legally able to enter into a binding agreement in your jurisdiction. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.

2. The service

Crestwave provides research, analytics, alerts, and workflow tools for market intelligence. Outputs are informational research aids only. Crestwave does not provide investment, legal, tax, accounting, or financial advice and does not recommend that you buy, sell, hold, or trade any security, commodity, digital asset, derivative, or other financial instrument.

3. Market data and AI outputs

Market data, third-party content, alerts, backtests, simulations, and AI-derived analysis may be delayed, incomplete, inaccurate, unavailable, or based on assumptions that do not match future conditions. You are solely responsible for evaluating information and for any decisions or actions you take.

4. Subscriptions and billing

Paid plans renew on a recurring basis until cancelled. You authorize Crestwave and its payment providers to charge applicable fees, taxes, and renewals. Cancellations take effect at the end of the current billing period unless otherwise stated. Refunds are provided only where required by law or expressly approved by Crestwave.

5. Acceptable use

You may not misuse Crestwave, interfere with service operation, scrape or resell the service, reverse engineer non-public components, bypass access controls, share paid access outside your account, use the service unlawfully, or infringe the rights of Crestwave or any third party.

6. Intellectual property

Crestwave and its licensors retain all rights in the service, including software, design, models, workflows, branding, and content. Subject to these Terms, we grant you a limited, revocable, non-transferable right to access Crestwave for your internal use.

7. Third-party services

Crestwave may integrate with third-party providers for authentication, payments, hosting, market data, analytics, communications, or AI infrastructure. Those providers may have separate terms and privacy practices. We are not responsible for third-party services that we do not control.

8. Disclaimers

Crestwave is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We do not warrant that the service will be uninterrupted, error-free, secure, accurate, or suitable for your specific needs.

9. Limitation of liability

To the maximum extent permitted by law, Crestwave will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenues, lost data, trading losses, or business interruption arising from or related to your use of the service.

10. Suspension and termination

We may suspend or terminate access if you violate these Terms, create risk for Crestwave or other users, fail to pay fees, or if continued operation is impractical or unlawful. You may stop using Crestwave at any time and may request account deletion through support.

11. Changes

We may update these Terms as the service evolves. Material updates will be reflected by changing the last updated date and, where appropriate, providing additional notice. Your continued use of Crestwave after updates means you accept the revised Terms.
